Assault and Battery Dismissed at the 24th District Court

Sometimes police get the wrong person and charge someone with a crime that is innocent. That was the case of our client that was heard at the 24th District Court in Allen Park. Luckily, he had the right criminal lawyer and we were able to get him a full dismissal of the charges against him after a long court battle. After several discussions with the city attorney, we were able to reach a dismissal, and we must commend the city attorney for doing the right thing especially in a case like this where there was tremendous pressure to convict someone.

Assault and Battery in Melvindale

Our client was out with his wife celebrating the birthday party of a family member. The party took place at the White Rhino Sports Bar in Melvindale. At the end of the night, when it was time to leave, our client walked out of the bar with his wife. They came in contact with a man that they had never met before. It was clear to our client that the man was looking for a fight. Our client was forced to defend himself. It was discovered later that the attacked had a reputation for being a troublemaker.

While our client was defending himself, one of the unknown attacker’s associates came outside and saw the fight. The associate then got into a fight with another individual outside, not our client. While the fight with the unknown associate was going on the associate was attacked by a third party, an unknown female with a weapon. According to the associate, he believes the weapon that was used against him was a box cutter. The bouncer came outside and told everyone to leave. The associate suffered significant injuries and went to the hospital.

Our client thought that being attacked by the stranger was the end of it until he and his wife were arrested and told that they would be facing charges accusing them of assaulting the associate.

Had our been convicted of assault and battery he would have faced jail time, fines, and restitution for medical bills. That is when criminal defense lawyer, Aaron J. Boria got on the case.

Court Line up

The associate was named the victim in this case, but we knew our client was not the person who cut him. There was a major identity issue in this case. We arranged to have the victim identify the parties involved in the matter. The victim stated with certainty that neither our client nor his wife were the assailant. The wife’s case was dismissed.

Due to the severity of the injuries in this case, and the fact that a fight occurred involving out client, the prosecutor was reluctant to dismiss the matter and even considered charging out client with disturbing the peace. Ultimately, after several court appearances and negotiating, the prosecutor did the right thing and dismissed the charges against our client. The victim himself stated the attacker was not our client, and it was our client’s statement that the only reason he was in a fight was because he was forced to defend himself against an attacker.

A warrant went out for another woman and husband believed to be the attackers. Their court matter is ongoing.
