Drinking and Driving - The average offender

All of us want to feel safe while we are driving on the road. The law is clear, over the limit under arrest, but what does that really mean? When I have asked a group of jurors during a DUI trial, “is it illegal to drink and drive” the answer is always, yes. The truth is, if you are under a .08 grams of alcohol per 100 milliliters you are not breaking the law.

The National Highway Traffic Safety Administration, among others including the legislature, believes that the average driver should be able to safely drive with that amount of alcohol in their system.

The stigma of a drinking and driving offense is something of amazement. It is the one offence that soccer moms, CEOs, judges, and even priests commit, but amongst the general public it seems to be more offensive then any felony committed by a drug dealer, pimp, or psychopath. 

Why is that? Is it because of the money that backs drug and alcohol testing facilities that benefit after every DUI conviction? Is it because of MADD and other extremist groups who have a multi million-dollar interest in DUI charges? Is it because the state makes millions of dollars of the offense? Who knows . . .

A drinking and driving offense can keep someone out of certain schools or from getting a promotion. We have seen teachers and others professionals loose their jobs because of a drinking and driving offense.

The majority of DUIs are committed by the average person, blow slightly above the legal limit, and never repeats the offense. Yet, we send fist time offenders to jail, force them to pay thousands of dollars, take their jobs, and destroy their lives.
