Expunging a criminal record as the same effect as if the case had been dismissed. You can legally tell employers that you have never been convicted of a crime.

Am I eligible for an Expungement?

Not all crimes can be expunged. Specifically, felonies with a maximum possible penalty or life in prison, criminal sexual conduct, and traffic offenses such as DUI cannot be expunged.

Usually, the crime you seek to erase off of your record can be the only offense on your record. For example, if you had been convicted of Retail Fraud and Assault you would be ineligible.

There is an exception, you can still expunge an offense off of your record if the only other offenses were punishable by 90 days or less and occurred before your 21st birthday. For example, if you had been convicted of attempted assault before your 21st birthday and had a retail fraud you could expunge either offense.

You cannot have any pending charges and 5 years must have passed since the completion of your sentence.
