If Police are Investigating You Call a Criminal Lawyer

A client of ours was being investigated by the Melvindale Police Department for an Assault related offense. When she found out she was being investigated for a crime she did the right thing and called Aaron J. Boria, PLLC. Three weeks later, a Melvindale detective contacted our office. Do I have to talk to the police?

Absolutely not! In fact, Supreme Court Justice Robert Jackson, a former prosecutor and attorney general, stated, “Any lawyer worth his salt will tell the suspect…to make NO statement to the police under any circumstances.” That quote comes from a prosecutor turned attorney general. You cannot get more pro police than that.

Whatever you do, make sure you do not consent to searches. That means it would be ill advised to let police into your home, or your car. Do not take a polygraph or any chemical testing without first weighing the potential consequences.

Police are looking for arrests that lead to convictions. Talking to police will only give them more information that could lead to your conviction, which is why you are told, anything you say can AND WILL be used against you in a court of law.

Police are also legally allowed to lie to you! They may make you promises like, “give us information and we will dismiss your case.” Don’t believe it, only a prosecutor can make that deal with you and have it be legally binding.

What to do if Police are Investigating me

Having a lawyer makes all the difference during a police investigation. When the words are not coming out of your mouth you are not running the risk of incriminating yourself. Additionally, an experienced lawyer will know what questions to answer, what questions not to answer, and when to avoid police contact entirely.
