Lawsuit Filed Against Employer of Canton-Based 'Serial Infector'

A Nebraska-based staffing firm hired a worker charged with starting a hepatitis C outbreak.

The staffing agency that hired a medical technician from Canton facing he started a hepatitis C outbreak in Exeter, NH, is now the subject of a lawsuit.

Nebraska-based Triage Staffing was sued by an attorney representing some of the victims of the outbreak.

The technician, Dave Kwiatkowski, was a "traveler" hired by Triage Staffing. The company places its employees at hospitals all around the country.

Triage placed Kwiatkowski at  in Exeter, NH, according to a legal complaint.

The complaint, which can be found above in the "PDFs" section, alleges Triage was negligent in hiring Kwiatkowski.

"Triage failed to exercise reasonable care when it hired Mr. Kwiatkowski in view of all of the circumstances surrounding the job," said the attorney, Domenic Paolini, in a statement.

Kwiatowski also worked at hospitals in six other states, including Michigan. Officials are if he spread his hepatitis C to other patients in those states.

Angela Minicuci from the Michigan Department of Community Health said in an email Monday she can not yet confirm Kwiatkowski's employment history in Michigan because of the ongoing investigation.

Kwiatkowski was called a "serial infector" by prosecutors. He's scheduled to be in court this week to face charges of fraud and tampering.
